Compliance & Privacy

ePrivacy Directive

Also: Cookie Law

The EU rules governing electronic communications and tracking, the law behind cookie consent and the consent requirements for marketing email, distinct from but working alongside GDPR.

Why it matters

Much of what marketers assume is GDPR is actually ePrivacy: whether you can drop a cookie, whether you can send a marketing email, whether you need consent first. Treating the two as one leads to confident, wrong decisions.

What good looks like

Compliance means getting consent before non-essential cookies and tracking, and meeting the consent rules for electronic marketing, on top of, not instead of, your GDPR obligations.

In the European market

The directive is implemented in national law, so the specifics differ by country, with Germany (via the TTDSG and UWG) among the stricter regimes. Treat Europe as several rulebooks.
